Commission Terms

-An initial payment of the commission’s cost (1/3 minimum) must be made before I will begin work. Any commission that is not 100% paid for will have at minimum one watermark obscuring the work, commissions must be paid for fully before this is removed.

-If possible, I will provide the final .PSD file upon request so that the commissioner can create edits of the image.

-Any revisions made to the drawing 10 days after completion may incur a fee.

-Commissions are nonrefundable at my discretion and commissions cancelled by the buyer may not always be refunded. However, refunds will be given if the commission is not completed within the given deadline or if you have received no updates within 30 days and request cancellation.

-Unless otherwise requested I retain the right to post a low resolution+watermarked version of the artwork to my website and public blogs.

-If artwork is not fully paid for in a reasonable amount of time (60 to 90 days after the final invoice) I retain the right to edit and resell the image. This will usually be done as a “YCH” (Your Character Here) sale, where the work will be stripped to the base, advertised, and then edited to suit the new commissioner. (Note: I may extend the payment timeframe if you talk to me about it!)

-I may reject commissions without explanation.

You will notify me if the work is being commissioned for a company and accept that I will charge industrial standard rates. If you do not clarify that I am creating work intended to be used by a company and buy artwork using my freelance prices I have the right to reclaim the usage rights until a payment equal with the industrial standard is made, alongside any compensation.
Note: I do not consider nonprofit charities, independent developers/authors, or small project creators as companies. I would still appreciate being told if my work will be used in a large-scale project such as a game or book, but it is not required.

Commission Copyright Policy

Artwork received for free (“requests”) do not fall under this section and may not be used commercially without prior permission. Please see the “Free Artwork” section of my copyright page for more information on requests.
YCH sales, while considered commissions, have their own copyright policies (please see the YCH section of my copyright page for more info).
Art that has been paid for with art (referred to as “art trades”) are considered commissions and fall under the rules below with the buyer being referred to as the “commissioner”.

-Anything you commission is, after completed and paid for, owned by you. You are permitted to use, edit, repost, resell, etc, any commission that you have paid for and which involves characters that belong to you without crediting me in the description.

-Commissioners have sole responsibility for reposted artwork, and I have no obligation to assist the commissioner if it is used by a 3rd party.

-As copyright is owned by the commissioner, purchased images are exempt from my website blacklist and commissioners may repost the purchased art with no restrictions.

-Although copyright is given to the commissioner, if they are asked about the origin of the work a link to my website or online profile should be given and credit cannot be taken for the work’s creation.

-If a commissioner buys an image of someone else’s character the copyright for the artwork is transferred to the character owner and not the commissioner.

-Copyright is not transferred on cancelled commissions or commissions that have not been paid for within a reasonable amount of time (60 to 90 days) after the commission’s completion, and I keep the copyright to the art. Cancelled commissions may not be used for any purpose.
